California Court of Appeal

In re Young, A131729

A petition for writ of habeas corpus is granted and the matter remanded to the Board of Parole Hearings with orders to vacate its previous decision and conduct a new parole-suitability hearing for the petitioner, where: 1) the Board's decision violated due process in that it did not reflect due consideration of all the relevant suitability factors and evidence, and rested largely on incorrect factual contentions and guesswork; and 2) there was no evidence supporting the Board's analysis that was rationally indicative of the petitioner's current dangerousness.
