California Court of Appeal
Willard v. AT&T Communications of California, Inc., B231137
In a suit challenging a telephone company's pricing for a service that suppressed names, addresses, and telephone numbers from the White Pages telephone directory and 411 directory assistance, the trial court's dismissal of the complaint is affirmed, where the trial court's decision to abstain from adjudicating the dispute was not an abuse of discretion, since: 1) judicial review of fees for nonpublished service and unlisted service is inappropriate, and overseeing service fees is best left to the California Public Utilities Commission; and 2) as a matter of law, the complaint did not state a violation of the plaintiffs' right to privacy.
