In a suit by a psychologist employed by a county, asserting claims for retaliation and for wrongful termination in violation of public policy, judgment in favor of the psychologist is reversed and the matter remanded for a new trial, where the trial court: 1) erred as a matter of law by concluding that the psychologist was "licensed" under Business and Professions Code section 2910 because she came within the "exempt setting" exemption accorded by that statute; and 2) abused its discretion by excluding evidence that the psychologist failed to obtain a license.
