People v. Superior Court (Menigoz), C069391

In eminent domain proceedings in which the Department of Transportation (DOT) and property owners agreed to a stipulated judgment, a peremptory writ of mandate is issued directing the superior court to vacate its award and determination of litigation expenses in favor of the property owners pursuant to Code of Civil Procedure section 1250.410, and to deny such expenses, where the statute did not apply because DOT accepted the property owners' final demand and thereby averted a trial.
