Mundy v. Lenc, B227962

In a suit under the Unruh Civil Rights Act alleging noncompliance with the Americans with Disabilities Act for a business owner's failure to provide the plaintiff with a van-accessible handicap parking space, the trial court's denial of a special motion to strike a cross-complaint is affirmed, where the cross-complaint, alleging that the parking lot claim was in violation of a settlement agreement and release after earlier litigation between the parties, was legally sufficient and supported by a sufficient prima facie showing of facts to sustain a favorable judgment.
