California Court of Appeal

Mayers v. Volt Management Corp., G045036

In a suit against an employer alleging several claims under the California Fair Employment and Housing Act, the trial court's denial of the defendant's motion to compel arbitration is affirmed, where: 1) arbitration provisions contained in the employment application, employment agreement, and employee handbook were unconscionable and therefore unenforceable; and 2) the unconscionable terms could not be severed from the rest of the arbitration provisions.
