California Court of Appeal

In re Ashton R., A131535

A dispositional order in dependency proceedings is reversed to the extent it ordered sibling visitation, where: 1) the visitation order was made by the court following the dispositional hearing in the sister's case; 2) at that hearing, the court did not have jurisdiction over the brother; 3) because the brother's father was not also the sister's father, the court had no jurisdiction over him at that hearing; 4) there was no statutory provision requiring sibling visitation under the circumstances; and 5) no section 388 petition by or on behalf of the brother was filed.
