In a case asserting causes of action for false imprisonment and violation of the Tom Banes Civil Rights Act, Civil Code section 52.1, arising out of the plaintiff's wrongful detention in county jail, judgment in favor of the plaintiff is: 1) reversed as to the section 52.1 cause of action and award of attorney fees under it, where the evidence was insufficient to establish the "threats, intimidation, or coercion" necessary to implicate section 52.1; and 2) affirmed on the claim for false imprisonment, where under the factual circumstances present--the damages attributable to each cause of action being identical--reversal of the false imprisonment verdict and associated damage award was not required.
