California Court of Appeal

People v. Mata, B226256

In a prosecution in which the trial court disallowed a peremptory challenge by the prosecution against a prospective juror as impermissibly race-based, but then reseated the juror instead of dismissing the venire, the judgment of conviction is reversed, where the trial court did not obtain the defendant's required waiver or consent to the reseating.
