California Court of Appeal

People v. Haraszewski, D056954

In a prosecution for 23 counts of various sex crimes involving four minors: 1) convictions for posing or modeling minors in violation of Penal Code section 311.4(c) are affirmed, where a) a defendant's act of directing a child to pose or model is not an element of the crime, and thus there was no error in jury instructions on this point, and b) there was sufficient evidence to support a section 311.4(c) conviction as to one minor; and 2) four convictions of duplicating child pornography with intent to distribute it to a minor in violation of Penal Code section 311.2(d) are affirmed against a contention that the evidence was insufficient to support four convictions, as section 311.2(d) authorizes a separate conviction for each image duplicated.
