California Court of Appeal
Glen Oaks Estates Homeowners Ass'n v. Re/Max Premier Properties, Inc., B229946
In a suit by a homeowners association (HOA) against two realtor groups, the trial court's sustaining of demurrers is reversed insofar as it determined that the HOA lacked standing, where the allegations of the complaint were sufficient to show the matter pertained to damage to common areas, and thus the Davis-Stirling Common Interest Development Act at Civil Code section 1368.3 supplied standing.
