Building a Better Redondo, Inc. v. City of Redondo Beach, B226499

On appeal of a writ of mandate compelling the City of Redondo Beach to submit a local coastal program amendment to public vote in compliance with a recently enacted charter amendment requiring any "major change in allowable land use" to be approved by city voters: 1) the appeal from the judgment is dismissed as moot, where the appellants voluntarily complied with the court’s writ of mandate, and the appeal presented fact-specific issues that were unlikely to recur and thus did not justify the court's exercise of discretion to resolve moot questions; and 2) the trial court's order awarding the plaintiffs attorney fees under Code of Civil Procedure section 1021.5 is affirmed, where there was no abuse of discretion in the trial court's assessment of appropriate attorney fees.
