In an action to confirm an arbitration award for securities fraud, the trial court's denial of the petition to confirm is affirmed, where: 1) the "denial" of the petition to confirm was construed as a dismissal, rendering it an appealable order; 2) the arbitrator's termination of the proceedings for lack of payment of fees did not constitute an "award" subject to confirmation; and 3) the trial court did not err in lifting a stay on litigation and setting the matter for trial after denying the petition.
