On petition for writ of mandate seeking an order directing the superior court to grant a motion to strike punitive damages allegations of a complaint against a health care services plan and health care providers, the petition is denied, where: 1) California Code of Civil Procedure section 425.13 does not apply to claims against health care service plans, so that the plaintiffs in the underlying suit were not required to comply with its requirements; and 2) the plaintiffs dismissed their punitive damages allegations against the health care providers.
