Berkeley Hillside Preservation v. City of Berkeley, A131254

On petition for a writ of mandate to set aside the approval of use permits to construct a large residence in the Berkeley hills, the trial court's denial of the writ is reversed, where there was substantial evidence of a fair argument that the proposed construction would result in significant environmental impacts, and thus the application of a categorical exemption from CEQA was inappropriate.
