SCI California Funeral Services, Inc. v. Five Bridges Foundation, A126053
In a dispute arising over the purchase of the assets of a cemetery, in which the plaintiff alleged that it did not receive an option agreement or easement as promised, the judgment of the trial court in favor of the plaintiff on its breach of contract claim is affirmed but the award of attorney's fees is reversed in part, where: 1) the plaintiff introduced legally sufficient proof of its damages; and 2) the trial court erred in denying the plaintiff's request for attorney fees under CCP section 998(d).
