People v. Borzakian, B229748

On appeal of a conviction for failure to stop at a red light signal at an intersection equipped with an automated red light enforcement system, the conviction is reversed, where: 1) there was a lack of evidence to support the violation, since there was nothing in the record to support the conclusion that a testifying police officer described the mode of preparation of the equipment maintenance logs in any respect or that the sources of information and method and time of preparation were such as to indicate trustworthiness; and 2) without the proper testimony, the maintenance logs and photographs were not properly admitted.
