California Court of Appeal
Alvarez v. Brookstone Company, Inc., D057567
In a suit alleging a retailer's violation of the Song-Beverly Credit Card Act of 1971 for requesting and recording her ZIP code as part of a credit card transaction, the trial court's judgment for the defendant dismissing the complaint after sustaining a demurrer is reversed in part, where Pineda v. Williams-Sonoma Stores, Inc. (2011) 51 Cal.4th 524, which held that requesting and recording a cardholder's ZIP code, without more, violates the Act, applied retrospectively to the defendant's conduct.
