California Court of Appeal

Santillan v. Roman Catholic Bishop of Fresno, B221409

In an appeal from a judgment of the trial court arising from a complaint for childhood sexual abuse by a former priest, judgment is affirmed because: 1) the court correctly granted co-plaintiff's motion for a new trial based on newly discovered evidence of another person who had reported abuse during the relevant period; and 2) the new witness's report occurred after the abuse of appellant so that the court correctly denied appellants motion for a new trial on the discovered evidence.
