California Court of Appeal

In re. David, B236792

In a habeas challenge to a Penal Code section 3003(f) order prohibiting petitioner from residing within 35 miles of the sister of a victim of his crime, order is vacated because: 1) a request by the next of kin does not satisfy the requirements of Section 3003(f); and 2) the restriction related the crime for which petitioner was convicted, related to the deterrence of future criminality, and reasonably related to the life, safety, or well being of anyone entitled to the application of such a restriction.
