In an appeal from summary judgment in defendant's favor in a Labor Code action for unpaid employee entitlements, judgment is affirmed because the court correctly concluded that the common law test for employment applied to determine whether plaintiff, who was defendant's nonexclusive insurance agent, was an "employee," instead of the broader statutory definition of "employee" contained in Labor Code section 2750.
