In an appeal from a judgment of the trial court declining to place appellant, an involuntarily committed mentally disordered offender, in outpatient treatment pursuant to Penal Code section 2972(d), appeal is dismissed because: 1) the patient bears the burden of proof on suitability for outpatient treatment under a reasonable cause, not preponderance of the evidence, standard of proof; and 2) the court has placed appellant in outpatient treatment since appeal.
