People v. Blackwell, A128197
Sentencing of defendant to life imprisonment without the possibility of parole for a first-degree murder he committed while a minor is affirmed where the sentence: 1) does not exceed the punishment allowable absent a jury determination of age and nor does it violate defendant's Sixth Amendment rights under Apprendi; 2) is not constitutionally cruel and unusual under Graham v. Florida; and 3) was not an abuse of the trial court's discretion.
