California Court of Appeal

In an appeal from a judgment in favor of the plaintiff in a tort action alleging that defendant-CHP officer negligently lost or destroyed the identifying information of an individual involved in an accident during which plaintiff was injured, judgment is reversed where because the information was lost during the course of an official investigation, the officer and the CHP are both shielded by Government Code section 821.61 immunity.
