In an appeal from an order of the trial court enjoining enforcement of Ordinance No. 320-08 pending the outcome of a legal challenge, order is vacated because Gov. Code section 66499.37 required plaintiffs' facial challenge to the Ordinance to be filed within 90 days of the enactment of the Ordinance, such that the plaintiffs have not shown a likelihood of success on the merits where their claims were not filed within the 90-day timeframe.
