California Court of Appeal

George v. Auto. Club of Southern California, B229287

In an appeal from a judgment of the trial court dismissing plaintiff's challenge to defendant-auto insurer's substitution of "fair market value" with "actual cash value" in assessing reimbursement for total loss, judgment is affirmed where plaintiff failed to plead facts that will create an inference that defendant knew that plaintiff was under a mistaken misimpression as to the meaning of the insurance contract use of the phrase "actual cash value."
