S.Y. v. S.B., C065700

In an appeal from a judgment of the trial declaring that appellant's former same-sex partner is a presumed parent of their adopted children under Family Code section 7611(d), judgment is affirmed because whether appellant intended for former partner to obtain legal rights with respect to the children is irrelevant where: 1) appellant allowed and encouraged partner to function as the children's second parent from birth; and 2) partner openly embraced the rights and obligations of being a parent.
