California Court of Appeal

Westamerica Bank v. City of Berkeley, A124238

In an appeal from a judgment of the trial court dismissing plaintiff’s complaint for equitable remedy of interpleader arising from a Code Civ. Proc. section 386 demand for liquidation of securities held in escrow, judgment is affirmed where plaintiff failed to state a claim because its complaint, taken together with subject escrow agreement, does not show a reasonable probability that the plaintiff will be subject to double claims which may give rise to double liability if it complies with the defendant’s demand.
