Conviction and sentencing of defendant for criminal threats and dissuading a witness for the benefit of a criminal street gang are upheld in part and vacated in part where, because of the tardy testimony of the victim, there was insufficient evidence at the time of defendant's motion for acquittal regarding some of the charges, and therefore the trial court erred by denying defendant's motion.
