In a challenge to an order of the trial court compelling arbitration of a "fee dispute" pursuant to Civil Code section 2860(c), order is vacated because when an insured raises in a bad faith action the duty to defend, breach and bad faith by an insurer, such issues must be resolved first in the trial court before a Section 2860(c) arbitration may be compelled.
