In an appeal from summary judgment of the trial court in favor of the defendant in an action alleging violations of the Brown Act (Act), Gov. Code, section 54950 et seq., and breach of a government contract, judgment is reversed with directions because: 1) members of the public are intended beneficiaries of a government contract whose terms require compliance with the Act, so that they have standing to sue for failure to comply; and 2) a government contractor cannot be sued directly under the Act because they are not a "legislative body" as defined by the Act.
