In an appeal from a judgment of the trial court dismissing plaintiffs' survivor action for wrongful death arising from the use of excessive of force, judgment is reversed where a criminal assault conviction of the victim's companion in the underlying incident does not bar the action under Heck and Yount because of the lack of privity.
