In a challenge to an order of the trial court denying petitioner-dependant the physician-patient privilege exception to Evidence Code section 994, order is vacated where the court erred in ruling that petitioner could not avail herself of the privilege to prevent real party in interest from subpoenaing her medical records of sexual history for in camera review by the court because petitioner did not tender her medical condition "in litigation" by disclosing a purported sexual abuse by real-party to authorities or by submitting to a forensic medical exam.
