In an appeal from a judgment of the district court dismssing plaintiff's action for slander of title, judgment is affirmed where the court correctly granted defendant's anti-SLAPP motion because plaintiff failed to meet its burden of demonstrating a probability of prevailing on the merits where the publication of subject lis pendens by defendant was privileged within the meaning of Civil Code section 47 subdivision(b)(4).
