California Court of Appeal

People v. Thomas, B228049

Conviction and sentencing of defendant for residential burglary are upheld where the trial court correctly denied his motion to suppress because DNA obtained from the preserved mouthpiece of a PAS device was not a search since defendant abandoned any privacy right he had in the saliva he deposited on the police device.
