Rental Housing v. City of Hayward, A128168
In an appeal from a judgment of the trial court invalidating defendant-city's mandatory residential inspection program, Hayward Municipal Code sections 9-5.306 and 9-5.401, judgment is reversed where Sections 9-5.306 and 9-5.401 neither sanction the imposition of penalties on owners for tenant non-compliance nor violate principles of substantive due process so as to make enforcement of the program unconstitutional.
