In a challenged to an order of the trial court denying petitioner's application for habeas relief from his conviction for second degree murder, judgment is affirmed where petition was not untimely and People v. Chun has retroactive effect, even though, based on the trial record, any error in instructing the jury on the felony-murder rule was not prejudicial.
