California Court of Appeal
Sanchez v. Valencia Holding Co., LLC, B228027
In an appeal from a judgment of the trial court denying defendant's motion to compel arbitration of a Consumers Legal Remedies Act class complaint, judgment is affirmed where subject arbitration provision is unconscionable and unenforceable because it is adhesive, involving oppression and surprise due to unequal bargaining power, and contains harsh one-sided terms that favor the car dealer to the detriment of the buyer that are not severable.
