In an appeal from a judgment of the trial court awarding respondent-city damages in an action for breach of a construction contract, judgment is affirmed where the "specified procedures" aspect Peter Kiewit was superseded by a 1965 amendment to Civil Code section 1511 such that the trial court's failure to consider whether appellant's late performance was caused by actions of respondent, on account of an extension of time provision contained in the agreement, was not erroneous.
