In an appeal from a judgment of the trial court dismissing plaintiff's medical negligence action on a motion in limine on the ground that the action was foreclosed because of a prior grant of summary adjudication in a medical malpractice complaint by the plaintiff, judgment is reversed where although plaintiff failed to object to defendant's improper use of in limine motion at trial, Flowers v. Torrance Memorial does not preclude her from proceeding on the merits of her negligence claim.
