People v. Daugherty, JAD11-08
In an appeal from a judgment of the trial court convicting defendant of failure to stop at a red signal on photos captured by traffic cameras, Vehicle Code section 21453(a), judgment is affirmed where the contract between City and the provider of the cameras, which included a "cost neutrality" provision that guaranteed City would never be obligated to pay more than the service provider collects in fines, was a violation of statute even though the violation does not render subject photos inadmissible but merely casts doubt on the presumed reliability of the photographic evidence.
