California Court of Appeal

In re P.A., D058816

In an appeal from the juvenile court's judgment of paternity based solely on the results of genetic testing, judgment is reversed where if a child has both a presumed and a biological father, the court, under Family Code section 7612, must hold an evidentiary hearing at which it reconciles the competing paternity interests to determine which of those interests are founded on the weightier considerations of policy and logic.
