Gutierrez v. County of San Bernardino, E050452

In an action for inverse condemnation against defendant-county and precipitated by substantial damages to plaintiffs' residences and property caused by a flood, judgment of the trial court in favor of the defendant is affirmed where: 1) a certain alignment was not a public improvement for purposes of inverse condemnation; 2) to the extent that a paved road was a public improvement, plaintiffs failed to submit any evidence that it was a cause of their injuries; and 3) defendant acted reasonably relative to its installation of subject K-rails.
