California Court of Appeal

Pacific Caisson and Shoring, Inc. v. Bernard Bros. Inc., B219199

In an action for breach of contract seeking payment for work performed under a subcontract, judgment in favor of defendant is reversed where because the trial court erred in ruling that plaintiff did not maintain a Class C-12 specialty license it was never duly licensed, it failed to reach the question of whether plaintiff nonetheless was entitled to recover because it substantially complied with the Contractor's State Licensing Law, Bus. & Prof. Code section 7000 et seq. and section 7031(e), where plaintiff's Class A license lapsed for only two and a half months during performance.
