Zelasko-Barrett v. Brayton-Purcell, LLP, A130540
In a labor and employment action alleging defendant's failure to pay overtime wages and other benefits on the ground that plaintiff-law clerk was employed in a professional capacity thus exempting it from the alleged wage and benefits obligations, summary judgment in favor of the defendant is affirmed where although plaintiff had not yet been licensed to practice law, he was nonetheless a law school graduate and performed duties that brought him within an exemption for those engaged in a learned profession.
