California Court of Appeal

People v. Bowles, D057119

In a criminal dispute involving the scope of Penal Code section 1054.5(b), judgment of the trial court granting a retrial as sanction for the prosecutor's failure to disclose exculpatory evidence is reversed where a trial court's power to grant sanctions under Section 1054.5(b) for such prosecutorial failure is limited to circumstances where the verdict has not yet been rendered on the charged crimes and while the trial court has jurisdiction over the criminal case.
