California Court of Appeal

In re Levi H., D059141

In a Family Law dispute concerning the juvenile court's jurisdiction and disposition orders placing children in out-of-home care based on a biological father's physical abuse, judgment of the court is affirmed where it: 1) properly designated the presumed father as a custodial parent based on a voluntary declaration of paternity he signed shortly after child was born, Fam. Code Sections 7570 et seq. and 7611; 2) properly weighed the presumption of fatherhood against abusive father; and 3) did not abused its discretion by removing the children from mother's custody on the ground she was unable or unwilling to protect them.
