City of Woodlake v. Tulare County Grand Jury, F060737

In a dispute arising from a Grand Jury investigation and involving the scope of Code of Civil Procedure section 1985, judgment of the trial court quashing a subpoena duces tecum for failure to serve without an affidavit of good cause is reversed because when a grand jury seeks records of a public agency to which it has been given express statutory access, its demand for production of those documents is not a section 1985 subpoena duces tecum, and therefore, a supporting affidavit of good cause is not required.
