California Court of Appeal
Mission Viejo Emergency Medical Associates v. Beta Healthcare Group, G043815
In an action for breach of the duty of good faith and fair dealing, breach of contract, and intentional and negligent infliction of emotional distress, judgment of the trial court is reversed where the court erred in denying defendant's motion to compel arbitration on the ground that the applicable arbitration provision was unenforceable because it was not disclosed in the application for an insurance policy, as: 1) the provision was clearly stated in the policy; and 2) no provision of law requires disclosure in the application.
