In a petition for a writ of mandate seeking to reverse the termination of plaintiff's employment from the police force after he was arrested for soliciting a prostitute and charged with violating Penal Code section 647(b), judgment of the trial court denying petition is affirmed where plaintiff repudiated a settlement agreement between the parties and the defendant properly elected to treat the repudiation as a breach of the agreement, entitling it to reinstate plaintiff's discharge.
